1. Ownership and Entity Information

Vybes Productions is a subsidiary of Island Reservations Ltd., registered and operating in the Turks and Caicos Islands. All media content offered on this platform is solely owned by Vybes Productions.

2. Media Content and Copyright

Vybes Productions owns 100% of all media displayed and sold on this platform. No media is sourced from third parties. Content is protected by international copyright laws.

3. Use of Likeness and Permissions

Media featuring individuals or public locations is assumed to be filmed lawfully in public spaces where no model or location releases were required. Vybes Productions does not currently maintain specific releases for all imagery.

4. Upload and Licensing Scope

Only Vybes Productions may upload content. No third-party content is accepted. All media is licensed under a single, standard license, available on our website.

5. License Terms

All purchases are governed by our Standard License Agreement, which outlines permitted uses, restrictions, and commercial rights. Customers agree to this license at the time of purchase.

6. Preview Access and Downloads

Users may view watermarked previews online. Free downloads are not permitted. Full-resolution media is only available upon purchase.

7. Refund and Return Policy

All sales are final. Refunds are only granted in cases of technical errors or clear mistakes on our part.

8. Promotions and Discounts

Promo codes may be issued periodically. Some are reusable, while others may be limited to a specific user account.

9. Permitted Usage and Restrictions

Media may be used across various industries, subject to the terms of the Standard License. Users may lightly edit media but may not distort it or degrade its quality.

10. Prohibition on AI Use

The use of our media in training or deploying any artificial intelligence system is strictly prohibited. All AI-related use rights are reserved by Vybes Productions.

11. Data and Privacy

User data is handled in accordance with our Privacy Policy, which outlines how we collect, store, and process personal information.

12. Hosting and Payment

Our platform is hosted via Vercel. All payments are securely processed using Stripe.

13. Delivery of Purchased Media

Upon purchase, customers can access downloads via their account page. A receipt will also be sent via email. All digital files are delivered through Amazon S3.

14. Account Termination

Vybes reserves the right to suspend or terminate user accounts at its sole discretion, with or without notice, for conduct that violates these Terms of Service or is otherwise harmful to the site or other users.

15. Indemnification

You agree to indemnify, defend, and hold harmless Vybes, Island Reservations Ltd., its affiliates, officers, directors, employees, and agents from any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses arising from your use of the site or violation of these terms.

16. Third-Party Services

Vybes utilizes third-party services such as Stripe and AWS for site functionality. Vybes is not liable for any failure, delay, or issue caused by these external services.

17. Copyright and Takedown Requests

If you believe that any content on the Vybes site infringes upon your copyright, please contact us immediately at yazaan@vybesproductions.com with the relevant details. We will review and respond to all valid requests in accordance with applicable law.

18. Business Transfers

If Vybes or Island Reservations Ltd. is involved in a merger, acquisition, or asset sale, your information and associated license rights may be transferred. We will ensure that any successor entity continues to honor these Terms of Service.

19. Force Majeure

Vybes shall not be held liable for delays or failure in performance resulting from causes beyond its reasonable control, including but not limited to natural disasters, internet outages, war, terrorism, labor disputes, or governmental actions.

20. Modifications to Terms

Vybes reserves the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the site. Continued use of the site after changes are posted constitutes your acceptance of those changes.

21. Governing Law and Jurisdiction

These Terms of Service are governed by the laws of the Turks and Caicos Islands. Any disputes shall be resolved through binding arbitration. Any dispute not resolved by arbitration shall be brought exclusively before the courts located in Turks and Caicos Islands.

These Terms of Service are provided in English only.
